A seconded employee works for a limited time in Finland, sent to Finland by his employer located in another country.
The posted employee usually works elsewhere than in Finland. His employer based in another country sends him to work in Finland for a limited period of time during the employment relationship.
The posting can be based on a contract between a Finnish and a foreign company or a labor hire agreement.
Hired labor, subcontracting or internal group assignments
The Act on Posted Workers contains the criteria for determining the minimum employment conditions for posted workers in work performed in Finland. From the point of view of a Finnish company, it is usually about foreign hired labor or subcontracting.
However, the provisions may also be applied, for example, in the internal commands of an international group.
The rules of the game are the same as for Finnish employees
According to the main rule, foreign labor must largely comply with Finnish labor legislation and generally binding collective agreements in the construction industry.
The rules of the game for posted workers are therefore the same as for the Finnish workforce. Only social security remains to be taken care of for posted workers according to the domestic legislation.
