According to the Aliens Act, the main contractor is responsible for ensuring that all those working on the construction site have the right to work in Finland. Each client and employer also have a corresponding obligation to ensure the right to work.
EU and EEA citizens have the right to work freely in Finland. The right to work for third-country nationals and stateless persons is basically based on a permit issued by the Finnish Immigration Service, which entitles them to work in Finland. Depending on the residence and work permit, the right to work can be granted for one or more industries and certain tasks. The main contractor and the employer must therefore check the extent of the right to work and the possible industry restriction, which appears on the reverse side of the permit card. From the occupational classification list maintained by Statistics Finland it is possible to check what work a person is allowed to do according to the industry restriction.
Information on the basis of the right to work must be kept for two years after the end of employment.
